Article 1: About These Terms
These Terms of Service (hereinafter referred to as “these Terms”) set forth the conditions for using the application (hereinafter referred to as “the Service”) provided by Team Kirottoh. By using the Service, you (hereinafter referred to as “the User”) are deemed to have agreed to these Terms, and a service agreement under these Terms shall be deemed to have been established.
We reserve the right to revise the content of these Terms at any time without obtaining the User’s consent, and the User shall accept such revisions without objection.
By using the Service after these Terms have been changed, the User is deemed to have agreed to the revised Terms without objection.
Article 2: Definitions
The terms used in these Terms shall be defined as follows:
(1) The Service: The service operated by us and any related services.
(2) The Site: The website where the content of the Service is published.
(3) The Content: All text, sound, still images, videos, software programs, code, and other such materials provided through the Service (including Posted Information).
(4) User: Any individual who uses the Service, regardless of whether they have completed user registration.
(5) Registered User: An individual who has completed the user registration process and uses the Service.
(6) ID: A unique string of characters held by a Registered User for the purpose of using the Service.
(7) Password: A unique code set by a Registered User corresponding to their ID.
(8) Posting: The act by a Registered User of publishing text, strings of characters, images, comments, etc.
(9) Posted Information: All information, such as text, strings of characters, images, comments, etc., published by a Registered User through Posting or similar actions.
(10) Personal Information: “Personal Information” as defined in the Act on the Protection of Personal Information.
(11) Registered Information: All information registered by a Registered User on the Site (excluding Posted Information).
Article 3: Management of Registered Information, etc.
- We shall not be liable for any disadvantage or damage incurred by a Registered User due to inaccurate or false Registered Information.
- The Registered User shall manage the information used to log in to the Service, among their Registered Information, under their own responsibility.
- If, at the time of login to the Service, the information transmitted matches the Registered Information as confirmed by a prescribed method, we shall deem such login as a genuine login by the Registered User and consider it as use by the Registered User.
Article 4: Handling of Content
- The User may use the content of the Service only within the scope specified by us.
- All rights related to all content provided through the Service are owned by us, and we do not grant the User any license or right to implement or use any patents, utility model rights, design rights, trademark rights, copyrights, or other intellectual property rights owned by us.
- The User is prohibited from reproducing, transmitting, transferring (including sales between Users), lending, translating, adapting, reprinting without permission, making secondary use of, using for commercial purposes, altering, disassembling, decompiling, reverse engineering, or otherwise using the content by any method beyond the scope of use specified by us.
- Notwithstanding the preceding paragraph, if the User loses their user eligibility due to withdrawal from the Service or other reasons, their right to use the provided content shall also be extinguished.
- Copyrights related to content (still images, videos, text information, and all other information) posted or otherwise transmitted by the User on the Service (including all copyrights stipulated in Articles 21 to 28 of the Copyright Act) shall belong to the User. However, at the time of transmitting the content, the User grants us a royalty-free, non-exclusive license to use said content in all countries. Furthermore, we shall be able to modify, change, or delete said content.
- The User shall not exercise their moral rights as an author within the Service.
Article 5: Prohibited Matters
Users must not post or share any content that may cause discomfort, harm, or offense to others, including but not limited to content that is violent, discriminatory, defamatory, obscene, or harassing in nature.
We have a zero-tolerance policy for objectionable content and abusive behavior.
If we determine that a user has violated this provision, we reserve the right to take appropriate actions, including but not limited to removal of the content, suspension of service access, or deletion of the user’s account, without prior notice. The user agrees to these conditions without objection.
In connection with the use of the Service, we prohibit the User from engaging in the following acts. If we determine that the User has violated any of these prohibited matters, we may take measures deemed necessary by us, such as suspending use or deleting posts, and the User shall agree to this without objection. Furthermore, the User shall be fully liable for any damages.
- Acts that infringe, or may infringe, upon the copyrights, trademark rights, or other intellectual property rights of us, other Users, or other third parties (hereinafter referred to as “Others”).
- Acts that infringe, or may infringe, upon the property, privacy, or portrait rights of Others.
- Providing the personal information of a specific individual.
- An act whereby one User holds multiple Registered User statuses.
- Registering as a User on behalf of a Registered User whose status has been suspended or invalidated.
- Acts that discriminate against or defame Others, or damage the honor or credibility of Others.
- Altering or deleting accessible content or information of the Service or content or information of Others.
- Impersonating us or Others.
- Transmitting harmful computer programs, etc., or making them available for Others to receive.
- Acts of sending unsolicited emails for advertising, promotion, solicitation, etc., or emails that cause disgust to Others; acts that interfere with Others’ email reception; acts of requesting chain mail forwarding; or acts of forwarding in response to such requests.
- Distributing information, equipment, or software for a.c. or circumventing access control functions of servers, etc.
- Acts that place an excessive load on servers beyond normal use of the Service, or acts that encourage such behavior.
- Reproducing, modifying, reprinting, altering, changing, reverse engineering, disassembling, decompiling, translating, or analyzing the functions provided by the Service.
- Acquiring the Registered Information of Others without their consent or by fraudulent means (including so-called phishing and similar methods).
- Using all or part of the Service for commercial purposes, regardless of the method of use.
- Using the Service without fulfilling procedures required by law, such as notification to or obtaining licenses from supervisory authorities, or other acts that violate, or may violate, such laws and regulations.
- Acts that obstruct the operation of the Service, acts that interfere with the exchange or sharing of information led by Others, or acts that cause disadvantage to us or Others, such as damaging credibility or infringing property rights.
- In addition to the preceding items, acts that violate laws, regulations, or these Terms of Service (including guidelines separately established by us), or acts that violate public order and morals (including acts of transmitting or displaying information that may encourage or induce violence, or cruel images, or acts of soliciting companions for suicide, etc.).
- Linking to data, etc., where any of the acts falling under the preceding items (including cases where Others are performing such acts) are observed, for the purpose of encouraging such acts.
- Any other acts that we deem inappropriate for a User.
Article 6: Handling of Personal Information, etc.
We shall handle personal information acquired by us appropriately, based on our separately established “Privacy Policy.”
Article 7: Modification of Terms
We may modify these Terms without obtaining the User’s consent for reasons such as the enactment, modification, or abolition of laws and regulations. In such cases, the modified Terms shall become effective from the time they are displayed on the Site.
Article 8: Disclaimers
- We shall not be liable for any damages whatsoever incurred by the User due to changes in the content of, interruption of, or termination of the Service.
- We shall not be liable for any disputes or troubles between the User and other Users. Even if trouble arises between the User and other Users, it shall be resolved under the responsibility of both parties, and no claims shall be made against us.
- We shall not be liable for any damages, whether direct or indirect, incurred by the User as a result of using the Service.
- The Service, as well as the content and information on the Site, shall be provided by us as they are available at that time. We make no warranties whatsoever regarding the completeness, accuracy, applicability, usefulness, availability, safety, certainty, etc., of the information we provide, text and other content and software, etc., registered or transmitted (sent) by the User.
- Although we may provide information or advice to the User from time to time, we shall not be responsible for the results thereof.
- We shall not be liable if the User loses any profit, revenue, information, or data, or incurs any consequential, special, indirect, punitive, or incidental damages arising out of or in connection with these Terms.
- The provisions of Paragraph 1 through the preceding paragraph shall not apply if we have acted with intent or gross negligence, or if the agreement falls under a consumer contract under the Consumer Contract Act.
- Even if the preceding paragraph applies, we shall not be liable for damages arising from special circumstances among damages incurred by the User due to acts of negligence (excluding gross negligence) on our part.
- If we are liable for damages in connection with the use of the Service, our liability shall be limited to the amount of usage fees received from the User in the month in which said damages occurred, and we shall not be liable for damages arising from special circumstances (including cases where we foresaw or could have foreseen the occurrence of damages).
Article 9: Interruption or Termination of the Service
If we determine that it is difficult to provide the Service, we may interrupt, change, or terminate the provision of all or part of the Service without prior notice to the User, and we shall not be liable for any disadvantage or damage incurred by the User as a result thereof. This includes, but is not limited to, the following cases:
- When performing regular or emergency maintenance.
- When the system load is concentrated.
- When we determine that the operation of the Service will be hindered.
- When it becomes necessary to ensure the security of members.
- When the Service cannot be provided due to fire, power outage, etc.
- When the Service cannot be provided due to natural disasters such as earthquakes, eruptions, floods, tsunamis, etc.
- When the Service cannot be provided due to war, riots, civil commotion, labor disputes, etc.
- In addition, when we deem a temporary interruption of the Service necessary for operational or technical reasons.
Article 10: User Registration Cancellation, etc.
If we determine that the User’s conduct violates these Terms of Service, we may take appropriate measures, including but not limited to, changing or deleting content, temporarily suspending the Service, deleting user registration, denying access to the Site, and claiming damages. We shall not be liable for any damages incurred by the User as a result of such actions by us.
Article 11: Prohibition of Assignment, etc.
This Agreement or any part thereof may not be assigned without the prior written consent of the other party. Any assignment made without such consent shall be void.
Article 12: Severability
If any provision of this Agreement is held to be illegal, invalid, or unenforceable under the laws of any jurisdiction, it shall not affect the legality, validity, or enforceability of such provision under the laws of any other jurisdiction, nor shall it affect the legality, validity, or enforceability of any other provision.
Article 13: Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. In the event of litigation between the User and us, the Tokyo District Court shall be the exclusive agreed court of first instance.
